All over the world, Litigation is the most recognized form of dispute resolution. However, it is known to be formal and inflexible. Navigating cases from the court of first instance up to the Supreme Court can be exhausting. In some instances, cases are ordered back for retrial.
This greatly affects the willingness of parties to want to resolve their disputes using Litigation. Other factors that discourage disputing parties is that litigation takes financial, emotional and sometimes social toll on the parties which are eager to put an end to.
This training will bring to the fore, the benefits of resolving disputes out of court, identify common pitfalls in out of court settlement and provide participants with the requisite tools to resolve conflicts out of court.

In Negotiations and Mediation sessions, a difference in cultural views can impede the process, especially where the issues in question are contentious.
Most people are influenced by cultural practices and these cultural practices cannot be denied or erased easily, even though we have seen cultural practices evolve over the years.
Where these cultural elements arise in a dispute, a mediator’s ability to understand and respect these diverging views is important to resolving the dispute.
For a mediator to provide solutions to disputing parties which will be mutually acceptable, the mediator must develop the necessary skills and level of awareness to the cultural biases of the parties and provide culturally acceptable solutions.
